Inflectra Corporation: Privacy Policy

Inflectra respects the privacy of its visitors and customers and understands the importance of privacy to visitors to our website. We collect and store information so that we can efficiently provide information to our users and process your requests for additional information and materials. This privacy statement is designed to help you understand what information we gather and what we do with the information.

  1. Your Information. Personal identifying information, such as your name, street or e-mail address, phone number or any other information which, when used by itself or with other data, might identify a you or your company is only collected if you send it to us voluntarily, as part of using our service, or provide such information in connection with a request for information. We may also use this information to send you notices regarding Inflectra products and services and to further personalize your experience on our website. Personal identifying information is used only for our legitimate business interests, including the aforementioned notices, to supply requested information, to answer your questions, and to comply with applicable laws and regulations.
  2. Disclosure. By giving Inflectra your personal identifying information, you grant Inflectra the right to use this information for reasonable business purposes and in a manner consistent with the policies of Inflectra and applicable state and federal laws and regulations. We do not sell, rent or disclose your personal identifying information to any third party, except as described in this section. We may contract with reputable vendors to assist us in processing information or delivering the items that you may request. These vendors are restricted from using or selling the information for any purpose other than helping us to provide the materials and requested services. We may provide aggregate statistics about our customers, online traffic patterns and related information to reputable third parties, but these statistics will not include any personally identifying information. Finally, if disclosure of any information is required by law or by an appropriate government authority, we will comply accordingly.
  3. Cookies. As part of offering and improving our services, we may use “cookies" to store and sometimes track information about our online customers and users. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. Cookies can make use of the web easier by saving status and preferences about a website. Some parts of our website, where you are prompted to log-in or that are customizable, may require that you accept cookies. Cookies by themselves cannot be used to find out the identity of any user. Most browsers are initially set to accept cookies but users can change the setting to refuse cookies or to be alerted when cookies are being sent. By using this website with cookies enabled in your browser you are providing implied consent to their use by this website.

  4. Remarketing. As part of Inflectra's advertising campaign, third party vendors, including Google, show your ads on sites on the internet. Third party vendors, including Google, use cookies to serve ads based on a user's prior visits to your website. Users may opt out of Google's use of cookies by visiting the Google advertising opt-out page.
  5. Your Control. You may, at any time, remove your personal identifying information from our database. If you have submitted personal identifying information to Inflectra, and you wish to have it removed from our records, please e-mail us at support@inflectra.com.
  6. Your Use. By using this website, you agree not to disrupt or intercept our electronic information posted on this website or on any of our servers. You also agree not to attempt to circumvent any security features of our website, and to abide by all applicable, local, state, federal and international laws. In the section of our website that allow you to access trial downloads, service patches and other registered customer materials, we do ask for some personal information, such as name, mailing address and e-mail address, but this information will only be used by Inflectra to supply these materials to you or contact you, if necessary, to respond to your request for information and to contact you directly to respond to questions, comments or inquiries. We also may use the information to notify visitors about updates, new products or services. By using this website, you consent to the collection and use of this information by Inflectra.
  7. Children. Inflectra strongly believes in protecting the privacy of children online (we define "children" as minors younger than 13). Therefore, Inflectra will not knowingly collect or use any personal information from children or knowingly allow children to register with us. Any information that is inadvertently collected from children will be deleted promptly upon discovery.
  8. Security. Inflectra always uses industry-standard encryption technologies when transferring and receiving data exchanged with our website. Inflectra has implemented appropriate security measures in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our website. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to or from our website, and you do so at your own risk. Once we receive your transmission, we will do our best to protect its security on our systems. IN THE UNLIKELY EVENT OF AN INTERCEPTION OR UNAUTHORIZED ACCESS DESPITE OUR EFFORTS, INFLECTRA SHALL NOT BE RESPONSIBLE FOR SUCH INTERCEPTION OR UNAUTHORIZED ACCESS, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) SUFFERED BY A CUSTOMER OR USER, EVEN IF INFLECTRA HAS PREVIOUSLY BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. INFLECTRA DOES NOT WARRANT, EITHER EXPRESSLY OR IMPLIEDLY, THAT THE INFORMATION PROVIDED BY ANY CUSTOMER SHALL BE FREE FROM INTERCEPTION OR UNAUTHORIZED ACCESS, AND DOES NOT PROVIDE ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EACH CUSTOMER IS RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF HIS OR HER INFORMATION.
  9. EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

    Inflectra is the creator of certain software products, and in connection with these software products, Inflectra provides product demonstrations, product development, product enhancements, cloud services, solution engineering services, professional technical services, data migration services, and product technical support services (collectively “Services”) for the benefit of its customers and prospective customers in the EEA and Switzerland through employees who may be located in the U.S. These U.S.-based employees may process Personal Data to provide Services to customers and prospective customers located in the EEA, and Switzerland.

    Customers using Inflectra’s cloud solutions are responsible for managing the data that they store within Inflectra’s cloud solutions. Customers determine the categories of Personal Data and other information that are stored by Inflectra. Similarly, Inflectra's customers and prospective customers who share data with Inflectra in connection with any of its Services determine which categories of Personal Data will be shared and for what purposes. Consequently, Inflectra does not generally know the categories of Personal Data to be processed or the purpose(s) of the processing unless and until Inflectra receives this information from its customers or prospective customers. 

    When Inflectra processes Personal Data, Inflectra does so only for the purpose of providing Services.

    Inflectra customers and prospective customers may choose to include Personal Data among the data stored within the Inflectra cloud or otherwise shared with Inflectra in connection with its provision of Services.

    Inflectra processes only the Personal Data that its customers or prospective customers have chosen to share with Inflectra. Inflectra has no direct or contractual relationship with the subject of such Personal Data (a "Data Subject"). As a result, when a customer or prospective customer shares Personal Data, the customer or prospective customer is solely responsible for satisfying all legal obligations owed directly to the Data Subject under applicable data protection laws.

    It is the customer's or prospective customer's responsibility to ensure that Personal Data it collects can be legally collected in the country of origin. The customer or prospective customer is also responsible for providing to the Data Subject any notices required by applicable law and for responding appropriately to the Data Subject's request to exercise his or her rights with respect to Personal Data. In addition, the customer or prospective customer is responsible for ensuring that its use of Inflectra’s cloud offerings or Services is consistent with any privacy policy the customer or prospective customer has established and any notices it has provided to Data Subjects.

    Inflectra is not responsible for its customers’ or prospective customers’ privacy policies or practices or for the customers’ or prospective customers’ compliance with such policies or practices. Inflectra does not review, comment upon, or monitor its customers’ or prospective customers’ privacy policies or their compliance with such policies. Inflectra also does not review instructions or authorizations provided to Inflectra to determine whether the instructions or authorizations are in compliance with, or conflict with, the terms of a customer's or prospective customer's published privacy policy or of any notice provided to Data Subjects.  Customers and prospective customers are responsible for providing instructions and authorizations that comply with their policies, notices, and applicable laws.

    1. NOTICE. Inflectra complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Inflectra has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. Inflectra has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/
    2. CHOICE. During initial user registration, users can choose whether they wish to share their information with authorized third parties located in the same geography to aid in the software evaluation process. Users always have the opportunity to opt–out or change preferences via a link in the footer of all non–transactional email messages. These options are made available in email messages delivered from our company. Alternatively, you may manage your preferences in the secure customer area of our website or simply email us at privacy@inflectra.com. Some communications (e.g. important account notifications, evaluation support information and billing information) are considered transactional and are necessary for all Inflectra customers and users. You must cancel your Inflectra account to unsubscribe from these communications. To cancel your Inflectra account, please email us at sales@inflectra.com.
    3. ACCESS. Data Subjects have the right to access the Personal Data an organization holds about them. If such Personal Data is inaccurate or processed in violation of the DPF Principles, a Data Subject may also request that Personal Data be corrected, amended, or deleted. 

      When Inflectra receives Personal Data in the role of data processor, it does so on its customer's or prospective customer's behalf. To request access to, or correction, amendment or deletion of, Personal Data, Data Subjects should contact the Inflectra customer or prospective customer that collected their Personal Data. Inflectra will cooperate with its customers' and prospective customers' reasonable requests to assist Data Subjects to exercise their rights under the DPF. Should Data Subjects not receive a response from the customer or prospective customer, they should contact Inflectra directly to escalate.

      When Inflectra receives Personal Data in the role of data controller, to request access to, or correction, amendment or deletion of, Personal Data, Data Subjects should contact Inflectra directly in the first instance.
    4. SECURITY. Inflectra is committed to safeguarding the Personal Data that it receives. While Inflectra cannot guarantee the security of Personal Data, Inflectra takes reasonable and appropriate measures to protect Personal Data in Inflectra’s possession from loss, misuse, unauthorized access, disclosure, alteration and destruction.

      Inflectra utilizes a combination of online and offline security technologies, procedures and organizational measures to help safeguard Personal Data.  For example, facility security is designed to prevent unauthorized access to Inflectra computers. Electronic security measures — including, for example, network access controls, passwords and access logging — provide protection from hacking and other unauthorized access. Inflectra also protects Personal Data through the use of firewalls, role-based restrictions and, where appropriate, encryption technology. Inflectra limits access to Personal Data to employees, subcontractors, and third-party agents that have a specific business reason for accessing such Personal Data.  Individuals granted access to Personal Data are aware of their responsibilities to protect such information and are provided appropriate training and instruction. 
    5. DATA INTEGRITY AND PURPOSE LIMITATION. Inflectra's customers and prospective customers are responsible for limiting their collection of Personal Data to that which is necessary to accomplish the purposes disclosed to Data Subjects and compatible purposes. They also are responsible for providing Inflectra with instructions or authorization for the processing of Personal Data consistent with such purposes.  

      Inflectra's customers and prospective customers also are responsible for ensuring that (a) Personal Data they collect is accurate, complete, current and reliable for its intended uses; and (b) Personal Data is retained only for as long as is necessary to accomplish the customer's or prospective customer's legitimate business purposes disclosed to the Data Subject and for compatible purposes. Inflectra will cooperate with customers' and prospective customers' reasonable requests for assistance in meeting these obligations.

      In the performance of Services, Inflectra will request only the minimum amount of information required to perform the applicable Services and will retain such information only for as long as necessary to provide the Services or for compatible purposes, such as to provide additional Services, to comply with legal requirements, or to preserve or defend Inflectra’s legal rights.
    6. RECOURSE, ENFORCEMENT & LIABILITY. Please see the separate "Independent Recourse" section below for details on how to contact us with a privacy question or complaint and your independent recourse should you not be satisfied.
    7. ONWARD TRANSFER. Inflectra may disclose Personal Data to subcontractors and third-party agents who assist Inflectra in providing Services to its customers and prospective customers. Before disclosing Personal Data to a subcontractor or third-party agent, Inflectra will obtain assurances from the recipient that it will: (a) use the Personal Data only to assist Inflectra in providing the Services; (b) provide at least the same level of protection for Personal Data as required by the DPF Principles; and (c) notify Inflectra if the recipient is no longer able to provide the required protections. Upon notice, Inflectra will act promptly to stop and remediate unauthorized processing of Personal Date by a recipient. Inflectra will remain liable for onward transfers to its subcontractors and third-party agents.

      Inflectra may also be required to disclose, and may disclose, Personal Data in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. To the extent permitted, Inflectra will inform its relevant customer or prospective customer before making such disclosure and provide it with a reasonable opportunity to object to such disclosure.

      Inflectra will not otherwise disclose Personal Data to third parties.
    8. ENFORCEMENT. As part of the EU-U.S. DPF and Swiss-U.S. DPF, Inflectra is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). 
    9. ARBIRTRATION. Under certain conditions, more fully described on the Data Privacy Framework website – Annex I, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.
  10. (European Union) General Data Protection Regulation (GDPR): The General Data Protection Regulation (GDPR) was created to align the data privacy laws across all EU countries. The GDPR came into effect in May 25th, 2018 and replaces the Data Protection Directive 95/46/EC. A major update within the GDPR is that the processing of any EU citizens’ information is now protected, regardless of whether the information processing is done within the EU or not, and regardless of where the data controller is located. If you are a citizen of the European Union (EU) or European Economic Area (EEA) and are using the Inflectra website, we will maintain your personal data in accordance with the principles of the GDPR as outlined in Appendix A of this privacy policy.
  11. California Consumer Privacy Act (CCPA): The California Consumer Privacy Act (CCPA) is a law that enhances the privacy rights and consumer protection for residents of California, United States.
    At the present time, Inflectra Corporation does not meet the necessary thresholds for being subject to this law. However, Inflectra is committed to your data privacy and complies with the EU GDPR which offers similar protections, and already has implements the protections required by the CCPA.
  12. Disclaimers. WHILE INFLECTRA HAS SAFEGUARDS IN PLACE TO PREVENT UNAUTHORIZED ACCESS OR INTERCEPTION, THERE IS NO ABSOLUTE GUARANTEE OF SECURITY. IN THE EVENT OF AN INTERCEPTION OR UNAUTHORIZED ACCESS, INFLECTRA SHALL NOT BE RESPONSIBLE FOR SUCH INTERCEPTION OR UNAUTHORIZED ACCESS, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) SUFFERED BY A VISITOR OR USER, EVEN IF INFLECTRA HAS PREVIOUSLY BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. INFLECTRA DOES NOT WARRANT, EITHER EXPRESSLY OR IMPLIEDLY, THAT THE INFORMATION PROVIDED BY ANY VISITOR SHALL BE FREE FROM INTERCEPTION OR UNAUTHORIZED ACCESS, AND DOES NOT PROVIDE ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN TRANSMITTING ELECTRONIC COMMUNICATIONS TO INFLECTRA, THE USER OF THIS WEBSITE IS REQUESTING THAT INFLECTRA SEND INFORMATION TO OR CONTACT THE USER REGARDING OUR PRODUCTS OR OUR SERVICES. INFLECTRA WILL MAKE EVERY EFFORT TO ACCOMMODATE REASONABLE REQUESTS FOR INFORMATION PERTAINING TO OUR PRODUCTS AND SERVICES IN A TIMELY MANNER BUT MAKES NO GUARANTEES FOR THE TIMELINESS OF SUCH RESPONSES. THE USER SHOULD BE AWARE THAT INFLECTRA IS NOT RESPONSIBLE FOR DELAY, NON-DELIVERY OR NON-RECEIPT OF ANY INFORMATION EXCHANGED BETWEEN INFLECTRA AND THE USER OR VICE-VERSA DUE TO INTERNET CONNECTIVITY PROBLEMS, MAN-MADE OR NATURAL DISASTERS, FORCE MAJEURE, COMPUTER MALFUNCTIONS OR INCORRECT CONTACT INFORMATION (INCLUDING BUT NOT LIMITED TO E-MAIL ADDRESSES, MAILING ADDRESSES, TELEPHONE, CELLULAR, PAGER OR FAX NUMBERS) SUPPLIED BY THE USER. INFLECTRA COOPERATES WITH INQUIRIES FROM LAW ENFORCEMENT AGENCIES AND WILL ASSIST IN ATTEMPTING TO IDENTIFY A USER WHEN INFLECTRA IS REQUIRED BY LAW TO DO SO OR WHEN INFLECTRA, IN THE EXERCISE OF ITS JUDGMENT, DETERMINES IT IS NECESSARY TO PROTECT ITSELF, ITS WEBSITE, SERVICES, CUSTOMERS AND OTHERS.
  13. Independent Recourse Mechanism. In compliance with the EU-U.S. DPF and Swiss-U.S. DPF, Inflectra commits to resolve complaints about your privacy and our collection or use of your personal information. European Union or Swiss citizens with inquiries or complaints regarding this privacy policy should first contact Inflectra by email at: privacy@inflectra.com, or in writing at the address listed below.
    In compliance with the EU-U.S. DPF and the Swiss-U.S. DPF, Inflectra commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the Swiss-U.S. DPF.
  14. Changes to the Privacy Policy. We may, at any time and without notice, add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on our website. If we decide to change our Privacy Policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. Any such change, update or modification will be effective immediately upon posting on the website.
